For Petitioner : Mr.T.Arul For Respondents : Mr.M.Mohamed Riyaz, Government Advocate (Criminal Side), for R1 1/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.18979 of 2026 ORDER This Criminal Original Petition is filed to quash the Final Report in C.C.No.233 of 2025 before the learned Judicial Magistrate, Thiruthuraipondi, Thiruvarur district. 2. Upon perusing the First Information Report, the materials collected during the investigation and the Final Report, it can be seen that the accused and the de facto complainant are neighbours and with reference to a dispute about the hens of the de facto complainant coming into the house of the accused and spoiling their house, there arose a wordy quarrel, on account of which, it is said that the accused have attacked the de facto complainant. The learned Counsel for the petitioners would submit that for such a trivial issue, the matter is dressed up as a serious criminal case and the Final Report is liable to be quashed. But, it can be seen that in the instant case, the injury is certified to be grievous and the Doctor concerned is also examined. Therefore, there are enough materials to proceed against the accused and this is not a case where this Court can interfere at this stage. 3. Therefore, the prayer made in this Criminal Original Petition 2/4 https://www.mhc.tn.gov.in/judis Crl.O.P.No.18979 of 2026 cannot be countenanced and as such, the same is disposed of. Considering the plea made by the learned Counsel for the petitioners, the presence of the petitioners before the Trial Court shall stand dispensed with, except for the hearings that may be insisted upon by the Trial Court.
