CRL OP No. 17981 of 2026 __________ Page1 of 4 IN THE HIGH COURT OF JUDICATURE AT MADRAS DATED: 16-07-2026 CORAM THE HON'BLE MR.JUSTICE C.KUMARAPPAN CRL OP No. 17981 of 2026 Pasupathi ..Petitioner(s) Vs The State Represented By Its, Inspector of Police, Kilpennathur Police Station, Tiruvannamalai District. ..Respondent(s) PRAYER : Criminal Original Petition filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, Act, 2023, pleased to direct the Respondent to enlarge the Petitioner on bail in the event of arrest of the Petitioner in the Crime No.92 of 2026 pending on the file of the Respondent. For Petitioner(s): Mr.S.Manikandan For Respondent(s): Ms..R.S.Indira, Government Advocate (Criminal Side)
ORDER The petitioner apprehends arrest for the alleged offence under Sections 296 (b), 126 (2), 118 (1), 351 (3) of Bharatiya Nyaya Sanhita, 2023, in Crime No.92 of 2026 on the file of the respondent police seeks anticipatory bail.
2. The case of the prosecution is that the petitioner, waylaid the defacto- complainant’s husband, abused him in filthy language and attacked him on his forehead with a sickle. 3. The learned counsel for the petitioners submitted that the petitioner is innocent and has been falsely implicated in this case. He further submitted that the petitioner is ready to abide by any stringent condition that may be imposed by this Court and is willing to co-operate for investigation. Hence, he prays to grant anticipatory bail to the petitioner.
4. The learned Government Advocate (Criminal Side) appearing for the respondent police submitted that the injured person has been discharged from the hospital. He further submitted that two previous cases of a similar nature have been registered against the petitioner. Hence, he opposed to grant anticipatory bail to the petitioner.
5. I have given my anxious consideration to the submissions made by the
learned counsel on either side and perused the materials available on record. 6.Based on the submissions made by the learned Government Advocate (Criminal side), although the injured person has been discharged from the hospital, the petitioner has two previous cases of a similar nature registered against him. This clearly demonstrates that he is a person of subverting justice by misusing the liberty granted to him by this Court at an earlier point of time. Hence, this Court is of the firm view that if the petitioner is enlarged on anticipatory bail, he is likely to commit similar offences with impunity. https://www.mhc.tn.gov.in/judis
CRL OP No. 17981 of 2026 __________ Page3 of 4 Therefore, this is not a fit case to enlarge the petitioner on anticipatory bail. Accordingly, this Criminal Original petition is dismissed. 16-07-2026 ep To 1.The Inspector of Police, Kilpennathur Police Station, Tiruvannamalai District. 2.The Public Prosecutor High Court of Madras. https://www.mhc.tn.gov.in/judis
