JUSTICE R.K. PATTANAIK Order No. ORDER 10.03.2026 01. 1. Heard learned counsel for the respective parties. 2. Instant petition has been filed under Section 482 BNSS by the petitioners seeking pre-arrest bail in connection with Kantamal P.S. Case No.21 of 2026 corresponding to Special Case No.34 of 2026 (NDPS) pending in the court of learned Addl. District & Sessions Judge-cum-Special Judge, Kantamal, Boudh on the grounds stated. 3. Perused the FIR as at Annexure-1. Mr. Panda, learned counsel for the petitioners submits that there is no bar under Section 37 of the NDPS Act and the FIR as at Annexure-1 relates to a police raid conducted in the forest area leading to the detection of cultivation of Cannabis plant. The Court finds from Annexure-1 that large area was cultivated for the said purpose and it is a hilly terrain. The involvement of the petitioners is suspected and they apprehend arrest in the hands of the police. Recorded the objection of the State. Considering the FIR lodged by the local police, this Court is not inclined to consider grant of pre-arrest bail of the petitioners, however, is of the view that they are at liberty to surrender before the learned court below seeking regular bail taking such a plea as to absence of bar under Section 37 of the NDPS Act for orders. 4. For the consideration of the bail plea of the petitioners, the case diary shall be made available to the court concerned. 5. The ABLAPL is disposed of accordingly. 6.
