No. 697 of 2026 __________ Page2 of 5 ORDER This petition has been filed seeking a direction to the respondents 1 and 2 to provide necessary police protection for fencing of the petitioner’s land comprised in Survey 163/12 situated at Thevaiyur South Village, Perambalur District pursuant to his representation dated 21-01-2026. 2. The case of the petitioner is that he purchased the land from Alagudurai, Periyasamy and Mariyaayi on 11.10.2025, and the same was registered as Doc.No.4270 of 2025. Thereafter, the patta and other revenue records were mutated in the name of the petitioner. When the petitioner attempted to put up fencing around his property, the vendors raised unreasonable objections, caused obstructions, and further threatened and chased away the manager of the petitioner, Arumugam. Earlier a complaint had been lodged, which was closed based on the undertaking given by the counter petitioners that they would not interfere with the petitioner’s peaceful possession and enjoyment of the property. Contrary to the same, again when fencing was again attempted, objections were raised. Hence, the petitioner lodged a complaint on 21.01.2026. As no action has been taken, the present petition has been filed. 3. The learned Additional Public Prosecutor submitted that an earlier complaint of a similar nature had been received, a CSR number was assigned, and based on the undertaking given by the counter petitioners, the complaint of https://www.mhc.tn.gov.in/judis WP Crl. No. 697 of 2026 __________ Page3 of 5 the petitioner was closed. Now, a similar complaint has again been received and is pending enquiry. The petitioner as well as the counter petitioners would be called for enquiry and appropriate steps will be taken. 4. Considering the submissions made by the learned counsel for the petitioner and the learned Additional Public Prosecutor for the respondents 1 and 2, that the petitioner as well as the counter petitioners would be called for enquiry and appropriate steps will be taken, this court directs the respondent police to conduct an enquiry on the complaint of the petitioner and to provide adequate protection to enable the petitioner to put up fencing around his property, unless there is any restriction or prohibitory order from a competent court. 5. With the above directions, this petition is disposed of. No costs. 6.
