HARI HARANADHA SARMA Tr.C.M.P.Nos.61, 105 & 108 of 2026 Common Order: Tr.C.M.P. No.61 of 2026 is initiated by the wife for transfer of O.S.No.233 of 2025, on the file of learned Civil Judge (Junior Division), Narsapuram to the Court of learned Civil Judge (Junior Division), Amalapuram, which was filed by her husband- the respondent against her for recovery of a sum of Rs.18,04,500/-. 2. Tr.C.M.P. No.105 of 2026 is initiated by the husband for transfer of H.M.O.P. No.217 of 2025 on the file of learned Civil Judge (Senior Division), Amalapuram to the Court of learned Civil Judge (Senior Division), Narasapuram, which was filed by the wife with a prayer for dissolution of marriage and other consequential reliefs. 3. Tr.C.M.P. No.108 of 2026 is filed by the husband for transfer of H.M.O.P. No.239 of 2025 from the Court of learned Civil Judge (Senior Division), Amalapuram to the Court of learned Civil Judge (Senior Division), Narasapuram, which was filed by him for restitution of conjugal rights. 4. Heard Sri Makireddy Manoj, learned counsel appearing for the wife and Sri A. Sai Raghava, learned counsel representing Sri Rambabu Koppineedi, learned counsel appearing for the husband. 6 AHHS, J Tr.C.M.P. Nos.61, 105 & 108 of 2026 5. Consequent to certain matrimonial disputes, the wife has initiated proceedings for dissolution of marriage, vide H.M.O.P. No.217 of 2025 on the file of learned Civil Judge (Senior Division), Amalapuram and husband has initiated proceedings for restitution of conjugal rights, vide H.M.O.P. No.239 of 2025 on the file of learned Civil Judge (Senior Division), Amalapuram. Both were pending before the Courts at Amalapuram. Consequent to certain settlement, which was subsequently abandoned, certain permanent alimony amount was parted viz., Rs.15,00,000/- out of the total agreed amount of Rs.28,00,000/-. The balance amount was not paid. Hence, the proceedings initiated for dissolution of marriage on mutual consent became abortive vide H.M.O.P. No.120 of 2024 on the file of learned Senior Civil Judge, Amalapuram. Thereafter, the wife has initiated proceedings for dissolution of marriage. For return of the part of the alimony parted with the wife, the husband has initiated a suit vide O.S.No.233 of 2025 on the file of learned Civil Judge (Junior Division), Narsapuram. 6. Seeking transfer of the suit initiated by the husband, the wife has filed a transfer application, vide Tr. C.M.P. No.61 of 2026, from the Court of Narasapuram to the Court of Amalapuram. Seeking transfer of the case initiated by the wife at Amalapuram and also the case initiated by him, which was for restitution of conjugal rights, the husband has filed Tr. C.M.P. Nos.105 & 108 of 2026. 7 AHHS, J Tr.C.M.P. Nos.61, 105 & 108 of 2026 7. The factors relevant for consideration of the prayers are: 1. The proceedings for mutual consent were initiated at Amalapuram, which were unsuccessful. 2. The proceedings for restitution of conjugal rights were initiated by husband at the Court of Amalapuram. 3. The proceedings for dissolution of marriage were initiated by the wife at the Court of Amalapuram. 4. The suit for recovery of alimony money parted is initiated at Narsapuram, but the money said to have been parted, consequent to the proceedings initiated at Amalapuram and the amount also said to have been delivered at Amalapuram. 8. Therefore, the jurisdictional aspect on prima facie test under Section 20 of CPC with reference to either cause of action or the test of residence of the defendant will have more balance towards the Court at Amalapuram. Therefore, the transfer of case from Narsapuram to Amalapuram deserves positive consideration. Further, as petitioner on himself initiated proceedings at Amalapuram, on his own volition, the present prayer for transfer of cases from Amalapuram to Narsapuram found not convincing. However, the learned counsel on both sides would also submit that if all these three matters are taken up together, there will be possibility of parties coming to settlement. 8 AHHS, J Tr.C.M.P. Upon considering the facts and circumstances stated above, this Court finds that the suit in O.S.No.233 of 2025 on the file of learned Civil Judge (Junior Division), Narsapuram, is fit to be transferred to the Court of learned Civil Judge (Senior Division), Amalapuram, for trial along with the two other connected cases pending, vide H.M.O.P. Nos.217 & 239 of 2025. However, whether they are to be clubbed, or common evidence is to be let in etc. shall be considered by the learned Judge at relevant point of time, depending upon the context of the case and both parties may make appropriate request at proper time. Further, the learned Civil Judge (Senior Division), Amalapuram is requested to explore the possibility of settlement, by way of conciliation between the parties by referring to appropriate Alternative Dispute Resolution (ADR), which shall include mediation. 10. In view of the above, all the three petitions are disposed of as follows: 1. Tr. C.M.P. No.61 of 2026 shall stand allowed. 2. Tr. C.M.P. Nos.105 & 108 of 2026 shall stand dismissed. 3. The suit in O.S.No.233 of 2025 from the file of learned Civil Judge (Junior Division), Narsapuram shall stand transferred duly indexed to the Court of learned Civil Judge (Senior Division), Amalapuram. 4. The learned Civil Judge (Senior Division), Amalapuram is directed to dispose of all the three cases, as per law, at the earliest, after exploring the possibility of settlement. 9 AHHS, J Tr.C.M.P.
