PUBLIC PROSECUTOR The Court made the following: ORDER: Criminal Petition has been filed under Sections 480 and 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’), seeking to enlarge the Petitioner/Accused No.2 on bail in Crime No.06 of 2026 on the file of Duggirala Police Station, Guntur District, registered against the Petitioner/Accused No.2 herein for the offences punishable under Section 194 of ‘the BNSS’. 2. There is no representation for the petitioner. The material averments in brief, is that the husband of Accused No.1 died under suspicious and unnatural circumstances. Based on the complaint lodged by the father of the deceased alleging that the death was unnatural, the present crime was registered. 3. Mr. Sandeep, learned Assistant Public Prosecutor, vehemently opposed the grant of bail to the petitioner. He submits that the case of the prosecution is that Accused No.1 conspired with the petitioner and Accused No.3 to murder her husband on account of the alleged illicit relationship between Accused No.1 and the petitioner. It is further alleged that Accused No.3 supplied sedative tablets, which were administered to the deceased before the commission of the offence. He further submits that the investigation has been completed and the charge sheet has been filed, revealing specific overt acts attributed to the petitioner. Hence, he prayed for dismissal of the Criminal Petition. 4. Heard the learned Assistant Public Prosecutor. Perused the record. 5. On a perusal of the record, it is seen that the investigation has been completed and the charge sheet has been filed. The allegation against the petitioner is that he, along with Accused Nos.1 and 3, conspired to commit the murder of the husband of Accused No.1. The offences alleged are grave and heinous in nature, and there are specific overt acts attributed to the petitioner. Therefore, this Court is not inclined to grant bail to the petitioner. The petitioner was arrested on 26.01.2026 and has been in judicial custody for the past 165 days. 6. The request of the Petitioner cannot be considered at this juncture, as accusation against the petitioner is well founded. There are no merits in the case for grant of bail to the Petitioner. Hence, this Criminal Petition is liable to be dismissed. 7. In the result, the Criminal Petition is dismissed.
