THIS WRIT PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER:
CORAM: THE HON'BLE SMT. JUSTICE LALITHA KANNEGANTI
ORAL ORDER
1. The present writ petition is filed seeking the following prayers: <A) To issue a Writ in the nature of Certiorari quashing the endorsement dtd: 17.10.2025 issued by the Respondent No.1 vide Annexure-F as null and void and pass appropriate orders. B) To Writ in the nature of Mandamus directing the Respondent No.1 to comply the order in W.P No.105596/2025 dtd: 23.09.2025 vide Annexure-E and furnish the details of the Authentication history and transaction information of the Aadhaar card from date of filing of missing complaint to till date. C) To issue any other Writ/direction which this Hon9ble Court deems fit under the fact and circumstances of the case in the interest of Justice and equity.=
2. It is the case of the writ petitioner that the petitioner9s son went missing on 19.12.2019 by sending a

message to his younger brother about leaving his home. In this regard, they filed a missing complaint on 20.12.2019. Based on that, Crime No.73/2019 was registered. In the meanwhile, on 26.12.2023, the Aadhaar Card of missing son of the petitioner has been accessed and a demographic authentication was done. The petitioner informed the same to the police authority and they tried to get the authentication history of the son of the petitioner. But the Unique Identification Authority of India having contained the confidential information of an individual, the police could not access the authentication history of the missing son of the petitioner. Then the second son of the petitioner has made a written representation to the respondent No.1 on 10.05.2024 seeking to furnish the details of the authentication history.
When the respondents have failed to disclose the same, the petitioner filed W.P.No.105596/2025, which came to be disposed of by a Co-ordinate Bench of this Court vide order dated 23.09.2025 directing the respondent No.1-UIDAI to furnish to respondent No.2 only the details of location of the usage of Aadhaar Card of the missing son of the petitioner from the time of filing of the missing complaint till the date of 15 days from the date of receipt of a copy of the order, so as to facilitate the investigation

by respondent No.2 and also made it clear that apart from the location of usage, no other details shall be furnished and the respondent No.2 shall not share such details/information with anyone else, apart from that required for the purposes of investigation. 3. It is the case of the petitioner that pursuant thereto, the respondent No.1 has issued the impugned endorsement stating that in compliance of the order dated 23.09.2025, the respondent No.1 has made all efforts to provide information in accordance with the provisions of Aadhaar Act, 2016 and amended thereto. It is intimated that no authentication data of the petitioner9s missing son is available with them from 01.04.2025 to 28.09.2025. In the intimation/endorsement, it is also stated that the authentication transaction data will be retained by the Authority for a period of six months and it will be deleted after six months, except when such authentication transaction data are required to be maintained by the order of a Court not inferior to that of a High Court or in connection with any pending dispute. It is the intimation of the respondent No.1 that they have not preserved the data and as such, they are not in a position to give the details of the petitioner9s son. - 5 -

4.
The learned counsel appearing for the petitioner submits that the Aadhaar Card of missing son of the petitioner was accessed on 26.12.2023 and on 10.05.2024 they gave a requisition to the respondent No.1. As the dispute is pending, they ought to have kept the transaction data. 5. The first relief sought is to implement the orders that are passed by the Co-ordinate Bench of this Court in W.P.No.105596/2025, for that another petition cannot be filed and the remedy of the petitioner seeking implementation of an earlier order passed in a petition is not by way of this petition but by filing a contempt. The second relief i.e., questioning the proceedings that the endorsement issued by the respondent No.1 is concerned, the respondent No.1 relying on the Regulation No.27 of the Aadhaar (Authentication and Offline verification) Regulations, 2021, that pertains to duration of the storage of data has categorically mentioned that generally the data they have to preserve is for a period of six months and if there is any
order from the Court, it will be preserved for a further time.
6. Admittedly, in this case, the order was passed in W.P.No.105596/2025 on 23.09.2025 and the Aadhaar Card is

accessed on 26.12.2023. Hence, it cannot be expected that the information exceeding period of six months will be with the respondent No.1. The respondent No.1 has explained the reasons why they could not give the information as per the order passed by the Court in the W.P.No.105596/2025. Hence, this Court finds that the endorsement given by respondent No.1 is in consonance with the Regulation No.27 of the Aadhaar (Authentication and Offline verification) Regulations, 2021 and this Court cannot interfere with the order impugned. Hence, this Court is passing the following:
ORDER (i) Accordingly, the writ petition stands dismissed. (ii) All I.As., in this writ petition stand closed.
