JUSTICE SURAJ GOVINDARAJ ORAL ORDER 1. The petitioners are before this Court, seeking for the following reliefs: "i. For a Writ in the nature of certiorari or any other writ or order quashing the proceedings in REV.APL.No.174/2022 is at Annexure-S initiated by BBMP Authorities under Section 178A of the KMC Act or under the provisions of the present BBMP Act, 2020; ii. Cost of the Petition." - 4 - HC-KAR NC: 2026:KHC:10080 WP No. 27877 of 2023 2. The grievance of the petitioners are that in a revenue appeal filed by the Bruhat Bengaluru Mahanagars Palake (for short, 'BBMP') an application for impleading filed by respondent No.5 has been allowed, which ought not to have been so allowed. Respondent No.5 is not concerned with the lis between the petitioners and the respondents in the BBMP. Respondent No.5 being a busybody, the application ought to have been dismissed. 3. Sri V.B.Shiva Kumar, learned counsel for petitioners submits that the action which has been taken against the petitioners is a belated action. In that particular matter, respondent No.5 as an impleading applicant cannot be permitted to come record. 4. Sri Madhukar Deshpande, learned counsel for respondent No.5 would submit that he is not a busybody. He is a neighbour of the property concerned of the said property, he alleges has been acquired way back in the year 1949 and designated - 5 - HC-KAR NC: 2026:KHC:10080 WP No. 27877 of 2023 for the purpose of a park and as such if the said property is used for any other purpose other than a park, the interest of the impleading applicant would be adversely affected. 5. In this regard, Sri V.B.Shiva Kumar, learned counsel for petitioners submits that there is no such reservation made for the park and as such, respondent No.5 is still a busybody who is trying to interfere with the rights of the petitioners. 6. Having heard the counsels, whether the property has been acquired or whether it has been reserved for a park or not, would have to be decided in Rev.Apl. No.174/2022, where the BBMP is asserting its rights over the property and negating the rights of the petitioners. 7. While doing so, respondent No.5 being a neighbour of the property, if at all the said property had been designated for the purpose of a park, the benefit of the same would be enjoyed by respondent No.5. - 6 - HC-KAR NC: 2026:KHC:10080 WP No. 27877 of 2023 8. If the property is put to any other use, the interest of respondent No.5 would be adversely affected. One other allegation made by Sri Madhukar Deshpande, learned counsel for respondent No.5, is that BBMP is not taking any active interest or taking any action against alleged violations by the petitioners. Assuming that to be so, it would be in the interest of justice that respondent No.5 be permitted to be on record to place such documents as may be necessary for the Appellate Tribunal to consider the revenue appeal in Rev.Apl.No. 174/2022. 9. The submission of all the counsels is that the pleadings are completed and that matter could be taken up for hearing, as regards which all the counsels will cooperate with the Karnataka Appellate Tribunal for expeditious disposal. 10. Placing their submissions on record, the Karnataka Appellate Tribunal is directed to dispose of the - 7 - HC-KAR NC: 2026:KHC:10080 WP No. 27877 of 2023 revenue appeal in Rev.Apl.No.174/2022 as expeditiously as possible. 11. All the respective counsels are permitted to file their respective synopsis, dates and events, lists of authorities and synopsis of submissions on the next date that the matter is listed, to enable the Karnataka Appellate Tribunal to expeditiously dispose of the matter. 12.
