The instant bail application has been filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of accused-petitioner in connection with FIR No. 1062/2025 registered at Police Station Shivdaspura, District Jaipur City (South) for offence under Sections 8, 21 and 25 of the N.D.P.S. Act 1985 and Section 111(2)(b) of B.N.S. Act 2023 and against the order dated 06.01.2026 whereby learned Trial Court dismissed the bail application filed by the accused-petitioner for the offence punishable under Section 8/29 of N.D.P.S. Act. 2. Heard. 3. Considered the submissions made by the counsel for the accused-petitioner as well as learned Public Prosecutor. [2026:RJ-JP:14085] (2 of 2) [CRLMB-796/2026] 4. The allegation against the accused-petitioner is of offence punishable under Section 8/29 of the N.D.P.S. Act. Police after completion of the investigation has submitted charge-sheet in the matter and the co-accused from whose possession contraband is said to have been recovered have already been enlarged on bail by this Court through separate orders. 5. Taking into consideration the overall facts and circumstances of the case, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the accused-petitioner on bail. 6. Accordingly, the present bail application is allowed and it is directed that the accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs.1,00,000/- (Rupees One Lax Only) together with two sureties in the sum of Rs.50,000/-(Rupees Fifty Thousand Only) each to the satisfaction of the learned Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so. 9. 9. However, it is made clear that in case the accused- petitioner is found to be involved in any other criminal case of similar nature in future, the prosecution would be at liberty to move an application for cancellation of this bail order.
