THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE S.R.KRISHNA KUMAR ORAL ORDER In this petition, petitioner seeks for the following reliefs: "i) Issue writ or order quashing the Impugned Order dated 17- 04-2026 bearing Number SA A ( A) ( Bem. U.NA.PA) P.AR/21/2025-26 passed by the 2nd respondent Against the petitioner vide Annexure-D, in the interest of justice and equity. ii) Issue any other incidental and consequential reliefs as deemed fit under the facts and circumstances of the case and in aid of the main relief sought for." - 3 - HC-KAR NC: 2026:KHC:24043 WP No. 13319 of 2026 2. When the matter came up before this court on 24.04.2026, this court passed the following interim order: ORAL ORDER ON I.Α.ΝΟ.1/2026 "Accepting the reasons stated in the affidavit accompanying application, I.A.No.1/2026 is allowed. Production of original / certified copy of Annexure dispensed with for the present. ORAL ORDER Sri.B.L.Sanjeev and Sri.B.S.Shrinivas, learned counsel are directed to accept notice for respondents. Copies to be served. Liberty is reserved in favour of respondents to seek vacation / modification of this order. Re-list on 29.04.2026 for preliminary hearing. In the meanwhile, there shall be an interim order of stay of impugned order dated 17.04.2026 passed by respondent No.2 at Annexure-D, till the next date of hearing." 3. In pursuance of the said interim order, it is contended the petitioner is continuing to work with the respondent. 4. Per contra, learned counsel for the respondent submits that the present petition may be disposed of reserving liberty in favour of the respondent to initiate and conduct the enquiry against him within a stipulated time frame. - 4 - HC-KAR NC: 2026:KHC:24043 WP No. 13319 of 2026 5. In view of the aforesaid facts and circumstances and the aforesaid interim order pursuant to which the petitioner is continuing his service, I deem it just and appropriate to set aside the impugned suspension order and direct the respondents to initiate enquiry proceedings, if any, against the petitioner and complete the same within a period of three months from the date of receipt of a copy of this order. It is further directed that till the respondents take appropriate action pursuant to the enquiry contemplated by them against the petitioner, the petitioner shall be continue to be entitled in service and the respondent shall not take any other precipitative/coercive actions/steps in relation to the same subject matter against the petitioner.
