Also heard Mr. K. Baishya, learned Additional Public Prosecutor appearing for the State of Assam. 2. This is an application under Section 482 of the BNSS, 2023 whereby the petitioner, Biplob Neog is seeking Anticipatory Bail apprehending arrest in Page No.# 2/3 connection with an FIR, which is registered as Pengaree Police Station Case No. 05/2026, arising out of G.R. Case No. 57/2026 registered under Sections 115(2)/196/126/351(3)/3(5) of the Bharatiya Nyaya Sanhita, 2023. 3. The FIR dated 22.02.2026 reveals that the informant who is the Project Manager of a Company, and who has employed 3 (three) workers in the Government project for improvement and upgradation of a road, states that when the workers had completed their work and was proceeding to their camp, the petitioner and few other persons, attacked them without any provocation. This is also alleged that during the incident the petitioner and others threatened them to kill them and abused them in the name of religion. 4. Mr. Kataki, learned counsel for the petitioner submits that for attracting Section 196 of the BNS, 2023, proper words, either spoken or written, or by signs or by visible representations, the disharmony or feelings of enmity, hatred or ill-will, should be discernible and in the instant case, no words or any signs or any representations were stated with the simple line that the petitioner and others had abused him in the name of religion which however cannot attract Section 196 of BNS, 2023. As such, the learned counsel for the petitioner prays for bail. 5. Mr. K. Baishya, learned Additional Public Prosecutor appearing for the State of Assam submits that pursuant to interim protection granted by this Court, the petitioner has appeared before the Investigating Officer and his statement has also been recorded. 6. Having regard to the above as well as the nature of the allegations, the prayer for pre-arrest bail is allowed. Page No.# 3/3 7. The order of interim pre-arrest bail dated 09.03.2026 is hereby made absolute. 8. It is further provided that the petitioner shall continue to co-operate with the investigation and make himself available before the Investigating Officer as and when called for and shall not try to influence the witnesses in any manner or hamper or temper with the evidences. 9.
