For Petitioner : Mr.M.Palani For Respondents : Mr.P.Siddarth Government Counsel, for R1 & R2 Mr.J.Vasu, Senior Panel Counsel, for R3 ***** O R D E R The petitioner, Tamil Nadu Driving Schools Owners Federation, a registered association, challenges the order dated 03.09.2025 issued by the second respondent, whereby a sum of Rs.1,27,34,000/- was sanctioned to the respective District Collectors for execution of civil works relating to the establishment of Automated Driving Test Tracks in the Regional Transport Offices. 2. The petitioner contends that the impugned order is contrary to Rule 15 of the Central Motor Vehicles Rules, 1989, inasmuch as it allegedly https://www.mhc.tn.gov.in/judis W.P.No.28147 of 2026 Page Nos.3/5 authorises the Regional Transport Officers to conduct driving tests in a manner inconsistent with the said Rule. 3. Heard the learned counsel appearing on either side and perused the materials available on record. 4. A plain reading of the impugned order shows that it merely sanctions funds to the District Collectors for carrying out civil works required for establishing Automated Driving Test Tracks. The order does not contain any direction regarding the manner, mode or procedure for conducting driving tests. It neither modifies nor overrides the procedure prescribed under Rule 15 of the Central Motor Vehicles Rules, 1989. 5. In such circumstances, the apprehension of the petitioner that the impugned order authorises the Regional Transport Officers to conduct driving tests contrary to Rule 15 of the Central Motor Vehicles Rules is wholly misconceived and without any factual basis.
