And In Re : Sujan Mandal and another ... Petitioners. Ms. Minoti Gomes, Mr. Jisan Iqubal Hossain ... For the Petitioners. Mr. Arindam Sen, Mr. Nirupam Dhali ... For the State. Learned advocate appearing for the petitioners submits that the petitioners are in custody for more than one year and 1000 bottles of Phensedyl were recovered from the joint possession of the petitioners. It has also been submitted that after conclusion of investigation, charge- sheet has been submitted, charges were framed and witness action has just commenced. Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that prosecution by relying upon 19 witnesses will prove its case. Having considered that for examination of 19 witnesses, some time will be required and the petitioners are already in custody for more than one year, without entering into the merits of the case, I am inclined to release the 2 petitioners on bail. As such, the prayer for bail of the petitioners is allowed. Accordingly, the petitioners viz., 1. Sujan Mandal and 2. Animesh Somadder shall be released on bail upon furnishing bond of Rs.20,000/- each, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Judge, Special Court under the NDPS Act, Raiganj, Uttar Dinajpur. If on bail, the petitioner shall be physically present on each and every date so fixed by the learned Special Court and shall not leave the jurisdiction of the district of Uttar Dinajpur without prior permission of the learned Special Court. The application for bail, being CRM (NDPS) 463 of 2026, is, thus, disposed of. All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
