The complainant has filed the present complaint alleging willful disobedience of the order dated 14.11.2025, passed by the learned Single Judge of this Court in W.P.No.32595/2025 (GM- CPC), directing the trial Court to collect an amount of `1,92,490/- and issue a certified copy as sought in the application. - 3 - HC-KAR NC: 2026:KHC:24240-DB CCC No. 463 of 2026 2. The order, disobedience of which is complained, lacks the clarity as to whether the directions have been issued to the Arbitration Center or the Commercial Court. 3. Since the substratal dispute was a subject matter of arbitration. The reference to Trial Court is not apposite. In view of the above, we are unable to accept that any proceedings for contempt of court are required to be initiated. 4. The complainant's grievance essentially is regarding non- furnishing of a certified copy of an arbitral award, notwithstanding that he has already deposited the amount as required before the Arbitration Centre. 5. It also appears from the order, the disobedience of which is alleged that the complainant is not a party to the arbitral proceedings. Since in terms of Section 42(A) of the Arbitration and Conciliation Act, 1996, the Arbitrator and the Arbitral Institutions are required to maintain confidentiality, the question whether an arbitral award can be released to a non-party requires examination. We, however, clarify that this order will not preclude the complainant from availing any substantive remedies in this regard, albeit in accordance with law.
