For Petitioner(s): Mr.C.Prabakaran https://www.mhc.tn.gov.in/judis __________ Page2 of 4 ORDER This revision has been filed to set aside the order 27.04.2026 in I.A.No.272 of 2024 in O.S.No.89 of 2021 on the file of the learned Principal Sessions Judge, Kallakurichi. 2.Heard the learned counsel for the parties. 3.The petitioners are challenging the order of appointment of an Advocate Commissioner in a final decree application in I.A.No.272 of 2024. 4.The learned counsel for the petitioners bring to my notice that in CMP.No.21269 of 2023 in AS.No.614 of 2023, this Court has granted an interim stay of passing of final decree as early as on 15.09.2023 and despite the said order, the Trial Court has proceeded to appoint an Advocate Commission in the final decree application. 5.I do not see any infirmity or error committed by the Trial Court in merely appointing a Commissioner. What all has been stayed is only passing of final decree and up to that stage, it is open to the trial Court to proceed with the matter, including the appointment of a Commissioner and up to the stage of the report being filed by the Commissioner. However, it is clarified that the Trial Court shall respect the order of stay granted by this Court in A.S.No.614 of 2023. No costs.
