...RESPONDENT(S): Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate writ, order or direction more particularly one in the nature of Writ of Mandamus declaring the action of the respondents in not releasing the payments amounting to Rs. 4,29,207/- to the petitioner for the work executed by the petitioner for providing O and M Repairs to Removal of Weed growth in Stuvartpuram Channel from KM 0.000 to KM 8.000 as per Agreement No. 62 KW/2022-23 Dated 25.03.2023 for an amount of Rs.4,29,207/- as illegal, arbitrary and contrary to law and un constitution and violation of Article 14 of Constitution of India and consequently direct the respondents to release an amount of Rs. 4,29,207/- with 18percentage interest per annum to the petitioner forthwith, and to pass IA NO: 1 OF 2026 Petition under Section 151 CPC praying that in the circumstances stated in the affidavit filed in support of the petition, the High Court may be pleased to direct the respondents to release an amount of Rs.

Heard Smt. Marella Radha, learned counsel for the petitioner and Sri Satish, learned Assistant Government Pleader for Irrigation and Command Area Development for the respondents. Page 3 of 4

The above writ petition was filed to declare the action of the respondents in not releasing an amount of Rs.4,29,207/- payable to the petitioner in relation to the work i.e., Providing O&M Repairs for removal of weed growth in Stuvartpuram Channel, vide Agreement No.62KW/2022-23 dated 25.03.2023, as illegal and arbitrary. 3. Today, when the matter is taken up for consideration, Smt. Marella Radha, learned counsel for the petitioner, would submit that the respondents released the amount to the petitioner, and no further adjudication is required in the writ petition. The statement made by the learned counsel is recorded and made part of the record. 4. Given the facts and circumstances of the case, the cause in the writ petition doesn’t survive. According, the writ petition is dismissed as infructuous. No order as to costs.
