Petitioner has filed this contempt petition alleging willful disobedience of the order dated 12.03.2018 passed in First Appeal No.559 of 2017 by respondent No.1. 2. Learned counsel for the petitioner submits that respondent No.1, after obtaining interim order in her favour, had transferred the property in dispute subject matter of First Appeal, in favour of other respondent and therefore she has committed contempt of order dated 12.03.2018. 3. Heard learned counsel for the petitioner and perused the documents annexed along with contempt petition as also record of First Appeal. 4. Perusal of order dated 12.03.2018 (Annexure C-1) which is stated to be violated by respondent No.1, would show that it is respondent No.1 who has preferred First Appeal No.559 of 2017 in which coordinate Bench of this Court has passed order protecting possession of appellant therein i.e. respondent No.1 . There is no order directing respondent No.1 not to alienate the property or create any third party interest. Grievance of the petitioner is that during pendency of First Appeal and in existence of the order dated 12.03.2018, property subject matter of First Appeal has been transferred in favour of other respondent. In order, subject matter of contempt, it only mentions that appellants shall not be dispossessed till decision on application for interim relief . 3 / 3 5. In the order which is stated to be breached by respondent No.1 Court has not restrained respondent No.1 from alienation of property or creating third party interest. 6. In the aforementioned facts of case, in the opinion of this Court, respondent No.1 has not disobeyed the order dated 12.03.2018 passed in FA No.559 of 2017. 7.
