For Petitioner(s): MR.S.MUTHUKUMARAVEL For Respondent(s): MR.M.MOHAMED RIYAZ GOVERNMENT ADVOCATE (CRIMINAL SIDE) https://www.mhc.tn.gov.in/judis CRL OP No. 18481 of 2026 __________ Page2 of 5 ORDER The prayer in this criminal original petition is to quash the FIR in crime No.137 of 2026. 2.Upon perusal of the First Information Report, when the premises at No.3 Chamiers Road, Raja Annamalaipuram, Chennai 28 was inspected by the concerned police, they found that several vehicles with LPG cylinders were being loaded and unloaded and several cylinders including filled up ones, both commercial and for home distribution were being dealt with in the said premises. Therefore, the case is registered with reference to two accused. As far as the first accused is concerned, the allegation is that he was using the said premises as an unauthorised godown for storing LPG cylinder, with an intention of diverting them to the black market. As far as the petitioner is concerned, he is arrayed as accused No.2. The allegation against him is that with reference to the cylinders allotted to him, they were found to be transported from one vehicle to another vehicle in the other premises. 3.The learned counsel for the petitioner would submit that his area of operation is only in and around Royapettah, though his godown is at Perungudi and therefore, for operational convenience, he used to assemble the vehicle in https://www.mhc.tn.gov.in/judis CRL OP No. 18481 of 2026 __________ Page3 of 5 the particular place and the loading and unloading is being done. The supporting bills for despatch and also the other bills for supplying only in lawful manner are all there with the petitioner. 4.It can be seen that when prima facie the place that is used was not designated place as a godown, upon inspection and on the strength of the reasonable apprehension, the FIR is registered and it is being investigated. If the petitioner’s claim is that everything is in accordance with the rules by the petitioner, even though he is an accused, if he chooses, he can place such materials before the Investigation Officer and the Investigation Officer shall dispassionately consider the same while proceeding further with the investigation and filing the final report. When the case is comprehensively registered against more than one accused on account of a place being unauthorisedly used for dealing with the Cylinders and there is a strong suspicion that the same is a sale to the black market, at the initial stage itself, this Court cannot thwart the very investigation and run its own chariot on the track of investigation.
