THIS PETITION, COMING ON FOR ORDERS, THIS DAY,
ORDER WAS MADE THEREIN AS UNDER:
CORAM: HON'BLE MR. JUSTICE R DEVDAS

HC-KAR NC: 2026:KHC:6293 WP No. 39108 of 2025
ORAL ORDER Learned Senior Counsel Sri.G.L.Vishwanath, appearing for respondent Nos.6 to 8 and 11 submits that the petitioner is the cousin brother of respondent Nos.9 and 10 who are already before the Karnataka Appellate Tribunal questioning the very same order passed by respondent No.3-Assistant Director of Land Records. Further that the said appellants have already filed an application for impleading the petitioner herein in the said proceedings. Learned Senior Counsel therefore submits that the Tribunal may be directed to allow the application, implead the petitioner in the said appeal and proceed in accordance with law.
2. Learned Senior Counsel Sri.Aruna Shyam, appearing for the petitioner however submits that the petitioner has a different cause of action when compared to respondent Nos.9 and 10 who are already before the Karnataka Appellate Tribunal. Since the petitioner had in fact challenged the order passed by respondent No.3-Assistant Director of Land Records before the Deputy Director of Land Records in proceedings bearing No.P.R.471/2023-2024. However, the Deputy Director

of Land Records issued an endorsement dated 28.12.2023 at Annexure-J rejecting the appeal filed by the petitioner.
3. At this juncture, learned Senior Counsel Sri.G.L.Vishwanath submits that the said endorsement was admittedly issued on 28.12.2023 and has attained finality. Moreover, the rejection of the appeal is further appealable or revisable before the competent authority and therefore, at any rate, the petitioner cannot file a writ petition challenging the two orders.
4. There is substance in the submission made by the learned Senior counsel for the respondents. If one of the aggrieved persons has already approached the Karnataka Appellate Tribunal, the petitioner is also required to undergo the proceedings before the Appellate Tribunal and cannot maintain this writ petition separately. If this writ petition is allowed, it will give rise to multiplicity of proceedings.
5. In that view of the matter, the writ petition stands
disposed of, reserving liberty to the petitioner to pursue the remedy before the Karnataka Appellate Tribunal. The tribunal is

also directed to consider the impleading application filed by the appellants therein, having regard to the observations made by this Court. Any other interlocutory application pending consideration also stands disposed of.
