(Oral) This writ petition has been filed by the petitioners seeking writ of Mandamus directing the respondents not to seal, confiscate the Bhumidhari land in Khata Khatauni No.32 Khasra No.113 Mi. admeasuring 1125 sqaure feets and not to take any other coercive measure actions including sealing, confiscating etc. in the aforesaid land without hearing the petitioners and adopting due process of law. 2. Petitioners are apprehending serious threats of sealing of their land for the reason that a letter has been issued by respondent No.2-Joint Secretary (Annexure No.3) to the CO of Police, Ramnagar, District Nainital, wherein, CO was asked to provide police force to remove the illegal colony Dev Green City on 13.02.2026 at 11:00 a.m. Pursuant to the said order, the main road in front of the illegal colony was demolished, which is reflected from Annexure No.3 to the writ petition. 3. Learned counsel for respondent Nos.3 and 4 made a statement at Bar that exercise for sealing and 2026:UHC:1395 2 confiscation of the aforesaid land would be done after providing adequate opportunity of hearing to the petitioners and after allowing them to submit documents of their ownership and possession of that land, in accordance with the provisions of Uttarakhand Urban and Country Planning and Development Act, 1973. 4. In view of the statement made by learned counsel for respondent Nos.3 and 4, the present writ petition is disposed of. 5. Pending application also stands disposed of.
