The instant writ application has been preferred by the petitioner for quashing the letter dated 25.11.2008 issued by the respondent no.3; whereby the petitioner has been made to superannuate w.e.f. 03.03.2009 as according to the respondents, petitioner attained 60 years of age on that day and his date of birth is 03.03.1949.

It has been further prayed that respondents concerned should take back the petitioner into the rolls of the company.

It has been submitted by learned counsel for the petitioner that the documents annexed with the writ application itself indicates that the petitioner has wrongly been superannuated. He refers to Annexure-7 which is the relevant portion of the admission register of the school from which the petitioner passed his Class VII examination and the same was issued to the petitioner. name is appearing at serial no. 12 also mentions petitioner’s date of birth as 28.10.1953 and the same has been certified by the Principal of the said school.

Learned counsel for the petitioner further relies upon the
judgment passed by the Co-ordinate Bench of this Court in W.P.(S) No. 4181 of 2008 titled “Ram Das Rajak v. Steel Authority of India Limited & Ors.” and also the judgment passed in “Kamta Pandey v. BCCL through Chairman-cum-Managing Director”.1

Learned counsel for the respondents opposes the prayer of the petitioner and relies upon the impugned order.

Having regard to the facts that the impugned order is dated 25.11.2008 and all the representations is made after the age of superannuation. Above all, the writ application has been filed almost after four years. The law is well settled that the issue of date of birth cannot be raised at the fag end of service. In the instant case, the impugned order is of 25.11.2008 and the representations and the certificates are all issued either after the date of superannuation or at the fag end of service.
There is no averment, whatsoever, as to why the petitioner sat over the matter for four years and the law in this regard is well settled.

Accordingly, the instant writ application is dismissed.
