has completed a minimum of two years of sentence including the remission or one half of his sentence and because the petitioner's husband satisfies neither, he cannot be admitted to parole. The petitioner's request for parole is based on medical report issued by the Chief Medical Officer, Central Prison Hospital, Bengaluru. The Chief Medical Officer's impression reads as under:
"Currently, he is admitted at Prison Hospital, Bengaluru. He is a known case of Hypertension, Diabetes Mellitus and Ischemic Heart Disease and diagnosed as CCF secondary to old IHD/Right Upper Limb Thrombophlebitis Recurrent TIA on medications and also facing difficult in sitting, standing and walking. He needs continuous medical care, bed rest and supporter for his routine activities."
The request for parole is considered in the light of this opinion and the details of the repeated hospitalization as recorded by the Chief Medical Officer in the report dated 26.11.2025 [Annexure-B]. Upon hearing Sri Lakshmikanth K., the learned counsel for the petitioner, and Sri B.Ravindranath,

the learned Additional Government Advocate, who is called upon to accept notice for the respondents, this Court is of the view that the petitioner has made out exceptional circumstances to be admitted to parole and this Court is also persuaded to admit the petitioner to parole because he would even otherwise be entitled for parole on completion of another month. Hence the following:

Thategowda] is admitted to emergency parole for a period of ninety [90] days subject to the terms as contemplated under the Karnataka Prisons and Correctional Services Manual 2021 and the fourth respondent is called upon to admit the petitioner's husband to parole upon terms as are found just and necessary and on executing appropriate surety.
