ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 2nd and 3rd respondent to survey the petitioner’s land and spot inspection by the letter issued by 1st respondent in Na.Ka.A3/12241874/2025 by virtue of the letter dated 14.11.2025.
2. The petitioner claims ownership over land measuring 2 acres and 15 cents, originally owned by her father. In 1990, her father entered into an agreement to sell 1 acre to one Kunjappa. As the purchaser failed to discharge the agreed bank dues, the petitioner's father instituted a civil suit and initially __________ Page2 of 6 https://www.mhc.tn.gov.in/judis
WP No. 16369 of 2026 obtained a favourable decree. However, the decree was reversed by the appellate Court in 2004.

The petitioner alleges that, taking advantage of her father's ignorance, the 4th respondent fraudulently obtained a sale deed for 21 cents in 1997 and subsequently secured mutation of his name in the revenue records. After the death of the petitioner's father in 2025, the 4th respondent obtained subdivision and a separate Patta (Patta No. 2902) for the said extent. The disputed land also constitutes the only access pathway to the petitioner's property, which is alleged to have been obstructed by the 4th respondent.

Aggrieved thereby, the petitioner submitted a representation dated 12.11.2025 seeking cancellation of the subdivision, which was forwarded by the Revenue Divisional Officer on 14.11.2025 to the Tahsildar and the Deputy Inspector of Survey for necessary action. Since no survey has been conducted till date, the petitioner has filed the present writ petition seeking appropriate directions. __________ Page3 of 6 https://www.mhc.tn.gov.in/judis

5. The learned Government Counsel appearing for the official respondents submitted that an enquiry has already been initiated and appropriate orders will be passed by the 1st respondent.
6. Considering the facts and circumstances of the case and the
submissions made on either side, this Court, without going into the merits of the matter, directs the 1st respondent to consider the petitioner's representation dated
12.11.2025. The 1st respondent shall afford a fair hearing to the parties after issuing due notice to the petitioner and the 4th respondent, and pass appropriate orders on merits and in accordance with law, within a period of eight (8) weeks from the date of receipt of a copy of this order.
