1. The instant interim bail application under Section 483 of the BNSS has been filed on behalf of the petitioner, who is in custody in connection with FIR No. 5/2024 registered at Special police station, ATS and SOG for the offences under Sections 285, 379, 411, 440 and 120-B of IPC and Sections 15(1), 15(2), 15(3), 15(4) and 16 of The Petroleum and Minerals Pipelines Act and Sections 3 and 4 of Explosive Substance Act and Section 3 and 4 of Prevention of Damage to Public Property Act and Section 7 of Essential Commodities Act on the ground of ailment of his wife Smt. Geetanjali Gupta. 2. Learned Public Prosecutor in pursuant to the order passed by this court has submitted the verification report of petitioner's wife Geetanjali Gupta which shows that she is admitted in the hospital
[2026:RJ-JP:15744] (2 of 3) [CRLMB-5832/2026] due to severe back-pain and her present condition is observed as unstable, the report also reflects that petitioner's wife need immediate surgery of spine at L-4, L-5 level. The report also points out that no attendant has been available at the hospital to care for the petitioner’s wife since her admission. 3. Therefore, considering the aforesaid verification report, including the medical prescriptions, the treatment provided to the petitioner’s wife, and the diagnostic reports along with the certification of the concerned doctor who has advised immediate surgery, this court deems it proper to allow the interim bail application of the petitioner for a period of two months from the date of his release. 4.
Accordingly, it is directed that the petitioner Sandeep Gupta S/o Late Vijendra Gupta, shall be enlarged on interim bail for a period of two months from the date of receipt of certified copy of this order, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge. It is needless to say that after availing interim bail, the petitioner shall surrender before the concerned jail authority after completion of aforesaid period. 5. The concerned jail authorities and the trial court are directed to send the report to this court regarding surrender of the petitioner
6. Furthermore, it is directed that in case the petitioner fails to surrender before the Jail Authorities within stipulated time, his bail bonds shall be forfeited and the proceedings for arresting the petitioner shall be imitated immediately by the trial court. (PRAVEER BHATNAGAR),J
