Learned counsel for petitioner submits that according to rationalization policy, junior-most teacher in a school is to be transferred and posted in another school. As per attendance register, which is placed on record as Annexure P-8 to writ petition, it is clear that there is a teacher who has joined the school subsequent to petitioner and therefore, said teacher ought to have been transferred as a surplus teacher. However, this aspect has not been considered by respondent authorities at the time of sending name of surplus teacher. 2. Learned State Counsel submits that representation submitted by petitioner against his transfer is rejected by the Divisional Level Committee constituted under the Rationalization Policy. Petitioner is having alternate remedy of submitting representation/appeal before the State Level Committee headed by the Director, Directorate of Public Instructions, Nawa Raipur. 3. Learned counsel for petitioner submits in view of objection raised by learned State Counsel, this writ petition may be disposed of permitting petitioner to submit representation/ appeal before the State Level Committee and in turn, the Committee be directed to consider and decide the 3 representation/appeal to be submitted by petitioner expeditiously within specific time frame. 4. On due consideration of submission of learned counsel for respective parties, without expressing anything on merits of case of petitioner, this writ petition is disposed of at this stage permitting petitioner to submit representation/appeal before the State Level Committee constituted under the Rationalization Policy, which is headed by the Director, Directorate of Public Instructions, Nawa Raipur. If such a representation/appeal is submitted by petitioner, the same shall be considered and decided by the State Level Committee in accordance with law expeditiously, preferably within a period of four weeks from the date of receipt of representation/appeal to be submitted by petitioner. 5.
