For Petitioner(s): Mr.S.Sengkodi For Respondent(s): Mr.Dominic S.David https://www.mhc.tn.gov.in/judis WP No. 26622 of 2026 __________ Page2 of 5 Order This Writ Petition has been filed challenging the impugned refusal check slip dated 15.05.2026 and seeking a further direction to the 3rd respondent to register the petitioner's Settlement Deed presented on 15.05.2026. 2. The learned counsel appearing for the petitioner submitted that originally, the petitioner’s great-grandfather, viz., Kuppamoopan, had purchased the properties in S.F.Nos. 162/1 and 162/2, measuring an extent of 6.41 acres of Punjai land situated at Karumanthur Village, Erode District. During his lifetime, he executed a Will dated 02.12.2006 in favour of the petitioner, and subsequently passed away on 21.07.2007. The aforementioned Will came into force upon the demise of the great-grandfather, following which the petitioner has been in possession and enjoyment of the property. Under such circumstances, the petitioner decided to settle the property in favour of his sister. Accordingly, he executed a Settlement Deed in her favour and presented it for registration, along with all relevant original documents. However, the 3rd respondent passed an order rejecting the application and issued the impugned refusal check slip dated 15.05.2026. Hence, the petitioner has approached this Court. 3. The learned Government Counsel appearing for the respondents submitted that if the document is re-presented, the respondents will conduct an https://www.mhc.tn.gov.in/judis WP No. 26622 of 2026 __________ Page3 of 5 enquiry by issuing notices to the other legal heirs and thereafter register the same in accordance with law. 4. Heard both sides and perused the materials available on record. 5. Considering the facts and circumstances of the case, this Court is of the view that the rejection of registration merely on the ground that the Will is unregistered, as submitted by the learned Government Counsel, is improper. The respondent can very well conduct an enquiry into the entitlement of the petitioner after the demise of his great-grandfather. Therefore, the impugned order is liable to be quashed. 6. In view of the above, the impugned order passed by the 3rd respondent dated 15.05.2026 is quashed, and the petitioner is directed to re-present the Settlement Deed for registration. Upon receipt of the same, the 3rd respondent is directed to register the Settlement Deed forthwith, as the registration of a Will is not mandatory. Furthermore, the petitioner, being the sole beneficiary of the Will, has voluntarily chosen to settle the property in favour of his sister; therefore, there is no impediment for the respondents to register the Settlement Deed.
