(ii) That the sureties of the Petitioner/A7 who are his mother and brother, who have executed bond for Rs.10,000/- by each shall pay each Rs.5000/- as penalty. While granting bail to the petitioner/A7, the Trial Court, while ordering the execution of the bond and surety, directed a cash security of Rs.10,000/- to be deposited by the petitioner/A7 and a cash surety of Rs.5,000/- each by the sureties. 3. Aggrieved by the same, the petitioner is before this Court. The word “penalty” shall be read as “cash surety” and it is not a penalty. As such, it is only a deposit, and it will be subject to the ultimate result of the case. The other things do not need modification. 4. The learned counsel for the petitioner submits that the amount is high, the petitioner is a daily wage earner, and he is not in a position to deposit the said amount. https://www.mhc.tn.gov.in/judis CRL OP No. 18806 of 2026 __________ Page3 of 4 5. Upon considering the same, the total sum imposed on the petitioner and the other sureties as a cash surety is only a sum of Rs.20,000/- and therefore, it cannot be said to be an onerous condition interfering with the right to life of the petitioner. Therefore, I am not inclined to modify the amount. The impugned order, at the relevant paragraphs, shall read as “Cash Security Deposit” instead of the word “penalty”. 6.
