For Petitioner(s): Mr.B.Vijay for Ms..G.Munuraj For Respondent(s): Ms.Inthu Karunakaran Government Counsel __________ Page2 of 7 https://www.mhc.tn.gov.in/judis WP No. 15762 of 2026 ORDER The present Writ Petition has been filed seeking the issuance of a Writ of Mandamus directing the 1st respondent to classified the land in Survey No.35/1 extent 1.21.0 hectare in Situate at U.Maramanagalam Village, Omalur Taluk, Salem District as Grama Arijana Natham(Valluvar) from Thooppu Poramboke as per proceeding in Na.Ka. 1051-1986 P, dated 29.07.2022 as well as proceeding in Na.Ka.3518845/2024/K4 passed by the 1st respondent on 05.11.2025 based on Order in W.P.No. 13459 of 2023 and consequently to direct the 5th to 7th respondents and servant or any third parties from in any manner illegal trespass entre into Survey No.35/1 extent 1.21.0 hectare in Situate at U.Maramanagalam Village, Omalur Taluk, Salem District until provide the said land to beneficiary. 2. The learned counsel for the petitioner submitted that the petitioner belongs to a poor socio-economic background and represents about 60 landless families residing at Valluvar Theru, U. Maramangalam Village, Salem District. Since 1980, the petitioner and the villagers have been continuously submitting representations to the authorities seeking assignment of Government land for house sites. __________ Page3 of 7 https://www.mhc.tn.gov.in/judis WP No. 15762 of 2026 3. Pursuant to the representations, the revenue authorities identified Government poramboke land measuring 1.21.0 hectares in Survey No.35/1 as suitable for assignment and recommended the proposal to the higher authorities through R.O.C. No.1051/86B dated 11.07.1986. A public notice was also issued, and proceedings were initiated for assignment of the land. Thereafter, despite subsequent proceedings dated 29.07.2022 and 05.11.2025, and the order passed in W.P. No.13459 of 2023, the respondents failed to implement the proposal and did not allot the land to the eligible beneficiaries. 4. The petitioner contends that the inaction of the respondents is arbitrary and therefore seeks a direction to implement the earlier proceedings and allot the land to the eligible landless families. 5. The learned Government Counsel for the respondents submitted that the first respondent is the competent authority to consider the case of the petitioner and pass appropriate orders. __________ Page4 of 7 https://www.mhc.tn.gov.in/judis WP No. 15762 of 2026 6. Considering the facts and circumstances of the case and the submissions made on either side, this Court directs the 1st respondent / District Collector, Salem District, to consider the representation of the petitioner dated 27.03.2026 and pass appropriate orders on merits and in accordance with law, in the light of the recommendation said to have been made by the Special Tahsildar, Adi-Dravidar Welfare Department, dated 29.07.2022 within a period of twelve (12) weeks from the date of receipt of a copy of this order, after issuing notice to all the interested parties. It is made clear that the revenue officials shall take an independent decision after considering all the facts and documents placed before them. 7. With the above observations and directions, this Writ Petition stands disposed of. There shall be no order as to costs.
