Crl.O.P.No.18043 of 2026 O R D E R The petitioner, who apprehends arrest at the hands of the respondent police for the offences punishable under Section 24(1) of COTP Act, Sections 123 and 132 of BNS Act, in Crime No.129 of 2026, on the file of the respondent Police, seeks anticipatory bail. 2. The case of the prosecution is that on 09.06.2026, the accused persons were found in illegal possession of 78 pockets of Supreme Pan Parag tobacco, 28 small pockets of Mava tobacco, 30 small pockets of Hans tobacco, one REDMI 9A black-coloured mobile phone and one REDMI 5G mobile phone and a sum of Rs.2,100/- being the sale proceeds of the tobacco products and one One plus Nord Ace mobile phone and one Redmi 9A Blue- coloured mobile phone. Hence, the case. 3. The learned counsel for the petitioner submitted that the petitioner has been falsely implicated in this case and that he has not committed any offence as alleged by the prosecution. He further submitted that no recovery was made from the petitioner and the petitioner is ready to abide by any stringent conditions that may be imposed by this Court. 4. The learned Government Advocate (Crl.Side), appearing for the respondent Police, reiterated the prosecution case and submitted that the petitioner has seven previous cases. Hence, he opposed the grant of anticipatory bail to the petitioner. 5. At this juncture, the learned counsel appearing for the petitioner submitted that out of seven cases, four cases were already disposed of. 6.
Notwithstanding the fact that no recovery was made from the petitioner, the petitioner is arrayed as accused No.1 in this case and the petitioner has seven previous cases, out of which, four cases were already disposed of by way of conviction. In such circumstances, this Court absolutely does not find any merit to consider this anticipatory bail petition. From his criminal history, this Court could see as to how he misused the liberty and subverted the course of justice. 7.
