JUSTICE SAMEER JAIN Order 28/03/2026 1. The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 31/2026 registered at Police Station GRP Kota District GRP Ajmer for the offence(s) under Section 8/15 of NDPS Act. 2. Learned counsel for the applicant has submitted that the applicant is sole bread earner of the family, aged about 37 years, having single antecedent registered against him, however, the same is reflected to be approximately a decade old. It is submitted that the applicant is behind bars ever-since 27.01.2026. It is also submitted that the recovered contraband i.e. Dodapost is 9 Kg is against commercial quantity of 50 Kg. 3. Per contra, learned Public Prosecutor has vehemently opposed the present bail application. [2026:RJ-JP:13175] (2 of 2) [CRLMB-4088/2026] 4. Having heard the contentions made by the counsel representing both the parties, upon a perusal of the material available on record and taking note of the fact that the applicant is sole bread earner of the family, aged about 37 years; that there is one criminal antecedent registered against the applicant however the same is approximately a decade old; that the applicant is behind bars ever-since 27.01.2026; that the recovered contraband i.e. Doda is 9 Kg is against commercial quantity of 50 Kg, but without commenting anything on merits or demerits of the case, this Court is inclined to enlarge the accused-applicant on bail. 5. Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Hardev Singh @ Kaka S/o Dilip Singh shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
