Mr. R.C. Joshi, Brief Holder for the State of Uttarakhand. 3. Petitioner is serving as Group-D employee in Sub-Treasury, Karnaprayag, District Chamoli. According to him, promotional avenues were created for Group-D employees by an amendment made in the Rules, vide notification dated 22.05.2023 and pursuant to which, promotion has been given to a Group-D employee in District Chamoli and now there is no vacancy available in Chamoli. 4. It is contended that there is a vacancy available in District Rudraprayag and as per the letter issued by Director, Treasury on 14.08.2025, Group-D employees can be transferred to other district to consider their claim for promotion. Learned counsel for the petitioner points out that District Magistrate, Chamoli has given NOC for transfer of the petitioner to Rudraprayag. 5. By means of this writ petition, following relief is sought: - “I. Issue a writ, order or direction in the nature of mandamus commanding and directing the respondents to consider and grant promotion to the petitioner from the post of ‘Class IV/ Anusewak’ to the post of ‘Assistant Accountant’ against the existing vacancy available in the office of respondent no. 5. i.e. Chief/ Senior Treasury Officer, Rudraprayag, District Rudraprayag as per law.” 2026:UHC:1406 6. Learned State Counsel submits that since petitioner has sought a writ of mandamus, but he has not made any representation, therefore, the writ petition is not maintainable. 7. Learned counsel for the petitioner submits that the writ petition may be disposed of by directing the competent authority to consider petitioner’s representation. 8. The writ petition is, accordingly, disposed of with liberty to petitioner to make representation to Director, Treasury.
