Ms. Prabha Naithani, learned counsel for the Applicant. 2. Mr. Pradeep Lohani, learned AGA, for the State of Uttarakhand. 3. In the High Court of Uttarakhand, the present case arises from Bail Application filed under Section 483 of Bharatiya Nagarik Suraksha Sanhita, 2023, seeking regular bail for the Applicant – Prem Joshi, who has been accused in FIR/Case Crime No.79 of 2026, dated 27.01.2026, under Sections 137 (2) and 74 of the Bharatiya Nayay Sanhita, 2023 and under Sections 9 (m)/10 of the POCSO Act, 2012, at Police Station Kotwali Jawalapur, District Haridwar. 4. The case of the prosecution, as per the FIR, is that on 26.01.2026, at about 8:00 or 8:30 AM, while the Informant/Complainant, 11 year old daughter was on her way to school, the Applicant lured her and took her on his scooty to a secluded spot near a canal bank. It is further alleged that the Applicant committed an indecent act and molested the victim and upon being spotted by a woman residing in the same colony, the Applicant abandoned the victim and fled from the spot. 5. Learned counsel representing the Applicant submits for the consideration of the bail that there is a delay in lodging of the FIR and the Applicant has falsely been implicated in the present matter. He further submits that the Applicant is
languishing in jail since 28.01.2026, and the Applicant has no criminal history. 6. Bail application of the Applicant – Prem Joshi, has vehemently been opposed by the learned State Counsel with a contention that it is a POCSO matter and the age of the girl is 11 years, and prays that the Applicant may not been enlarged on bail. 7. Considering the overall facts and circumstances of the case, the Applicant has not made out a case for bail.
Consequently, the bail application of the Applicant – Prem Joshi, who has been accused in FIR/Case Crime No.79 of 2026, dated 27.01.2026, under Sections 137 (2) and 74 of the Bharatiya Nayay Sanhita, 2023 and under Section 9 (m)/10 of the POCSO Act, 2012, at Police Station Kotwali Jawalapur, District Haridwar, is hereby rejected.
