S.A.Sr.No.64486 of 2012: This Second Appeal is filed against the judgment and decree dated 05.10.2010 made in A.S.No.13 of 2008 on the file of the learned Sub Judge, Sankari, confirming the judgment and decree dated 30.08.2007 made in O.S.No.248 of 2002 on the file of the learned District Munsif, Sankari. The appeal suit had been dismissed on 05.10.2010. The copies have been made ready and delivered on 05.08.2011. The petitioner claims that he was feeling sick for 6 months. However, the same is not supported by any medical certificate. Even granting six months period, it expired in February, 2012. The appeal came to be filed only in June 2014. Absolutely no explanation has been offered for the period from February 2012 to June 2014. Unless and until sufficient cause is shown, this Court cannot condone the delay for over a period of 1 ½ years. As there is no explanation, this Court is not in a position to accept the reason given by the learned counsel that the Court fee could not be generated. The suit is one for bare injunction. The Court fee payable is Rs.30.50. The explanation offered by the counsel is not found in the affidavit. Therefore, as there is no sufficient cause, this Civil Miscellaneous Petition stands dismissed.
