HC-KAR NC: 2026:KHC:3443 W.P. No.39493/2025
in O.S.No.74/2019 filed an application under Order VI Rule 17 read with Section 151 of CPC seeking to amend the plaint on the ground that the respondents-defendants in their written statement at paragraph No.27 have specifically averred that other than the suit schedule properties, there are other number of properties standing in the name of the plaintiffs and defendants and they are not included in the suit. It is submitted that this aspect was required to be clarified, hence, the proposed amendment was moved, which came to be rejected by the trial Court on the erroneous finding that the application is filed after five years. It is further submitted that unless the petitioners amend the plaint, they would not be able to effectively cross-examine the defendants' witnesses. Therefore, it is necessary to amend the plaint. Hence, seeks to allow the writ petition. 3. I have heard the arguments of the learned counsel for the petitioners and perused the material available on record. - 7 -

4. It is to be noticed that the petitioners have filed O.S.No.74/2019 for the relief of partition and separate possession of the properties referred in schedule 'A' to 'D' referred in the plaint. During the pendency of the proceedings, an application came to be filed under Order VI Rule 17 read with Section 151 of CPC seeking for amendment of the plaint, which came to be rejected by the trial Court under the impugned order. 5. A perusal of the proposed amendment would indicate that the petitioners intend to incorporate paragraph No.17(a) in the plaint by clarifying that certain properties are belonging to different persons and they are self-acquired properties of them and not the joint family properties. 6.
The issues framed by the trial Court clearly indicate that the burden is on the petitioners/plaintiffs to prove that the whether the plaintiffs and defendants Nos.1 to 5 constitute a Hindu Joint Family and the suit properties

are their ancestral properties, whether the plaintiffs prove that the sale deed dated 31.10.1989 and 17.08.2006 are not binding on them, whether the defendant Nos.10 to 13 prove that they are the absolute owners in possession of suit schedule 'A' properties by virtue of the sale deed dated 17.08.2006? 7. A perusal of the aforesaid issues and the pleading on record indicate that the proposed amended would not help the petitioners-plaintiffs in discharging the burden to prove the issues framed in the suit. The assertion of the respondents-defendants in paragraph No.27 of their written statement cannot be a ground to seek amendment of the plaint. The petitioners are required to prove that the properties claimed in the suit are the joint family properties and they are co-parceners along with the defendants. To adjudicate the suit for partition, the proposed amendment is not necessary and it is an admitted fact that the proposed amendment is sought after commencement of trial, the trial Court taking

note of the embargo under the proviso under Order VI Rule 17 of CPC, rejected the application. I do not find any error in the impugned order of the trial Court calling for interference in the present petition. The petition is devoid of merits and accordingly, the same is rejected.
