THIS PETITION, COMING ON FOR ORDERS, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned Additional Government Advocate takes notice for respondent Nos. 1 to 7. Notice to respondent Nos.8 and 9 are not necessary for the followings reasons. - 4 - HC-KAR NC: 2026:KHC:4697 WP No. 39339 of 2025 2. Learned Additional Government Advocate submits that the petitioner is espousing a public cause and is seeking action to be taken against the private respondents herein on the ground that the said respondents have encroached upon public property. 3. There is substance in the submission made by the learned Additional Government Advocate. 4. A plain reading of the representation at Annexure-A given by the petitioner on 16.08.2022, makes it clear that the petitioner is making allegations against the private respondents herein that they have encroached upon government property in Survey No.16 of Alageri Village, Kasaba Hobli, Thirthalli Taluk, and he is seeking action against the said respondents. When admittedly, the property in question does not belong to the petitioner and on the other hand, it is also clear that the petitioner claims to be the owner of the neighbouring property that by itself will not give any cause of action to the petitioner, as no private interest of the petitioner seems to be harmed. - 5 - HC-KAR NC: 2026:KHC:4697 WP No. 39339 of 2025 5. Accordingly, the writ petition stands disposed of, reserving liberty to the petitioner to file public interest litigation, if the petitioner chooses so. Learned Additional Government Advocate is permitted to file memo of appearance within a period of four weeks from today. Sd/- (R DEVDAS) JUDGE rv List No.: 1 Sl No.: 22
