It can be seen that the complainant was to be cross-examined and the accused did not utilise the opportunity. Thereafter, when an application under Section 311 of Cr.P.C., is filed in Crl.M.P.No.360 of 2026, the same is allowed with the costs of Rs.2000/- to the witness. The same is taken exception to. 3. The learned Counsel for the petitioners would submit that when the opportunity has to be given to the accused, costs should not have been imposed. 4. I have considered the said submissions made. 5. In this case, it is not as if penal nature of costs is imposed. Whenever a witness is recalled, the expenses of the witness have to be paid. No exception can be taken to. 6. Therefore, finding no merits, the Criminal Original Petition stands disposed of. It will be open for the petitioners/accused to deposit the cost within 7 working days from the date of receipt of a web-copy of this order.
