( In all the petitions) For Petitioner(s): Mr. V.R.Venkatesan For Respondent-1: Mr.M.Mohamed Riyaz, Government Advocate ( Crl side) COMMON ORDER The prayer in the above Criminal Original petitions are to quash the final report filed in C.C.Nos.148,49,153,154,156,157,159 and 160 of 2025 on the file of the learned Chief Judicial Magistrate, Tiruvarur. 2. The learned counsel for the petitioner would submit that the petitioner was a Special Officer who was made in-charge of several societies. On the very same set of allegations, this Court had set aside the surcharge proceedings in https://www.mhc.tn.gov.in/judis CRL OP No. 18163 of 2026 __________ Page4 of 6 CRP No.512 of 2020 by an order dated 20.12.2023 holding that no liability would be fastened on the petitioner. Therefore, the continuation of the present criminal proceedings is unsustainable. 3. I have considered the said submission made by the learned counsel for the petitioner and perused the material records of the case. 4. It is the simple allegation in the criminal case that when the loan was sought to be disbursed, the cheque was prepared in the name of one Sridhar, in which the petitioner has signed the cheque and thereafter, the Secretary, by forging the signature of the payee encashed the cheque and it is the further allegation that all of the accused in connivance with each other misappropriated the said amount. 5. The learned counsel for the petitioner would factually deny the same and would submit that being the Special Officer, his signature alone was obtained in the cheque and he has nothing to do with the encashment of the amount. Firstly the same is factual in nature. Secondly already, the Trial has commenced and P.Ws.1 and 2 have been examined and all the accused, including the petitioner, have been cross examined the said witnesses. Keeping open the liberty of the petitioner to raise all grounds during the course of trial, the above Criminal Original petitions at this stage cannot be entertained.
