Issue notice to the respondents 3 & 4, returnable by 12.08.2026. Private notice is also permitted. 3. The learned counsel for the petitioner would submit that in this case, there is a partition suit, pertaining to the subject property, pending in OS.No.600/1999. The final decree has to be passed in IA.No.1/2022 in the aforesaid suit. Under these circumstances, at the instance of respondents 3 & 4, the official respondents had issued notice for conducting survey and demarcation of the subject property. However, according to the petitioner, no survey or demarcation can be done prior to the passing of final decree in the aforesaid suit. Considering the submission made by the petitioners, it is clear that a suit, pertaining to the subject property is pending and no final decree is passed till date. Under these circumstances, this Court feels that it would be appropriate for the official respondents to conduct survey and demarcation of the subject property after the passing of final decree in the aforesaid suit, otherwise it will create unnecessary disputes between the parties.
