2. The Writ Court granted relief in favour of the appellant. Appellant was terminated from service and he raised an industrial dispute in ID No.358 of
2002. An order was passed to reinstate the appellant along with the benefits. The management preferred writ petition. Writ court passed an order on 06.02.2025 and the relevant portion is extracted hereunder:
“… 9. In the afore stated circumstances, the Writ Petition is disposed of by confirming the order passed by the Labour Court in ID. No.358/2002 by directing the petitioner Management to settle the terminal benefits to grant continuity of service and settle the terminal benefits of the petitioner along with attendant benefits. The petitioner is directed to settle the terminal benefits and all other attendant benefits due to the first respondent workmen within a period of eight weeks from the date of receipt of a copy of this order.”
3. Writ court pertinently confirmed the order of the Labour court passed in ID No.358 of 2002. Therefore misconception of the appellant that award may not be implemented is incorrect. If at all award is not implemented, he has to approach the competent Labour Court for execution of award under Industrial Disputes Act. https://www.mhc.tn.gov.in/judis
