1. Mr. I.D. Paliwal, learned counsel for the petitioner.
2. Mr. Ganesh Kandpal, learned Additional Advocate General for the State of Uttarakhand.
3. Petitioner is serving as Gram Panchayat Vikas Adhikari. He was appointed in District Almora, but vide
order dated 22.11.2023, he was attached at Dehradun. His attachment is cancelled vide order dated 27.04.2026 passed by District Panchayatraj Officer, Dehradun, which is under challenge in this writ petition.
4. In the impugned order, reference is made to the order dated 24.04.2026 passed by State Government and consequential order dated 25.04.2026 issued by Directorate of Panchayatraj.
5. Learned State Counsel submits that the attachment
order was cancelled pursuant to the liberty given by this Court in its judgment rendered in WPSS No. 224 of 2025. He further submits that petitioner does not have a right to remain attached forever at Dehradun and attachment is meant to deal with some emergent situation for a short period. He further submits that petitioner remain attached at Dehradun for three years and there is nothing wrong, if he is asked to go back to the place where he was appointed, as the post petitioner is

Learned counsel for the petitioner submits that petitioner has a mentally challenged son, who is undergoing treatment at Dehradun, therefore, cancellation of his attachment order has serious consequences for the family. He further submits that other similarly situate persons, who were also attached, have been permitted to remain at the place where they were attached.
7. Learned State Counsel submits that if that is the case, then petitioner can make representation to the Competent Authority.
8. The writ petition is, accordingly,
disposed of with liberty to petitioner to make representation to Director, Panchayatraj. If he makes representation within four days from today, decision thereupon shall be taken by the Director within three weeks thereafter. For a period of four weeks or till decision is taken, whichever is earlier, status quo qua petitioner’s posting shall be maintained.
