THIS PETITION, COMING ON FOR PRELIMINARY HEARING, THIS DAY, ORDER WAS MADE THEREIN AS UNDER: - 3 - HC-KAR NC: 2026:KHC:1566 WP No. 38466 of 2025 CORAM: HON'BLE MR. JUSTICE R DEVDAS ORAL ORDER Learned High Court Government Pleader takes notice for all the respondents. 2. It is the grievance of the petitioner that his application at Annexure-H dated 23.09.2025, though received by the respondent-Tahsildar, Magadi Taluk, no action is taken on the said representation. It is the contention of the petitioner in the representation that his grandfather-Late Sri.Guruppa alias Guruvayya S/o Thimmaiah purchased 12 Acres of land in (Survey No.32), New Survey No.35 of Singri Palya Village, Magadi Taluk, under a registered sale deed dated 01.02.1950. Therefore, on the strength of the registered sale deed, the petitioner is seeking mutation entry of his name in the revenue records as the petitioner claims to have succeeded to the property purchased by his grandfather. - 4 - HC-KAR NC: 2026:KHC:1566 WP No. 38466 of 2025 3. Learned High Court Government Pleader submits that no information have been furnished by the petitioner regarding the mutation entry made in favour of the petitioner's grandfather pursuant to the registered sale deed, which is of the year 1950. 4. This Court has held in several such cases, that the Tahsildar is duty bound to consider such representations, issue notice to all concerned, more particularly, the present kathedars and previous kathedars, if any, call for objections, afford an opportunity of hearing and thereafter, pass necessary orders if there is no objection from any other person. On the other hand, if there are any objections and there are disputed questions of title, then the Tahsildar is required to issue an endorsement to the petitioner to approach a competent Civil Court to get a declaration of title and accordingly, the mutation entries will be carried out. - 5 - HC-KAR NC: 2026:KHC:1566 WP No. 38466 of 2025 5. Accordingly, the writ petition stands disposed of with a specific direction to the 4th respondent-Tahsildar, Magadi Taluk to consider the representation given by the petitioner in the light of the observations made herein above. The representation of the petitioner shall be considered and disposed of in accordance with law as expeditiously as possible and at any rate within a period of 3 (Three) months from the date of receipt of a copy of this order.
