Mr. Lal Mohan Basu, …for the State Mr. Dyutiman Banerjee, Mr. Debjit Dutta …for the respondent nos.5 to 7 Learned counsel appearing for the petitioners submits that the petitioners claim right, title, and interest over RS Plot Nos. 30, 31, 32, and 33, Mouza Santospur, Police Station Bagnan, District Howrah, by virtue of a registered sale deed. It is alleged that unauthorized construction is being carried out on the said plots without any sanctioned plan. Learned counsel appearing for respondent nos. 5, 6, and 7, on the other hand, specifically submits that no construction is being undertaken by them on the said plots. It is further submitted that the said respondents have already filed WPA No. 9694 of 2024 before this Court seeking permission to raise construction, and until such permission is granted, no construction will be undertaken. 2 In view of the foregoing, this Court finds no justification to keep the present writ petition pending. Accordingly, the writ petition is disposed of with a direction upon the Pradhan, Antila Gram Panchayat (respondent no. 4), to ensure that no unauthorized construction is undertaken by any party on the said plots of land. Accordingly, W.P.A. 8322 of 2025 is disposed of. There shall be no order as to costs. The Photostat copy of this order, if applied for, be supplied to the parties on an urgent basis.
