This appeal seeks to challenge an order dated 7th March 2025 in O.S.No.493/2019 passed by the XXXI Additional City Civil & Sessions Judge, Bengaluru (hereinafter referred to as the ‘Impugned Judgment’). By the Impugned Judgment, the learned Trial Court has partly decreed the suit of the respondents/plaintiffs directing the appellant/defendant to quit and deliver vacant physical possession of the suit schedule property to the respondents/plaintiffs within three months from the date of the order. In addition, it was also directed that the appellant/defendant shall make payment of amount of Rs.3,84,000/- with interest at 6% p.a. from the date of HC-KAR NC: 2026:KHC:23942-DB RFA No. 1335 of 2025 3 suit till the date of its payment, towards arrears of rent, as well as Rs.48,000/- per month towards mesne profits/damages to the respondents/plaintiffs. 2. The learned counsel for the parties submits that they have settled the matter outside the Court. 3. Learned counsel for the appellant/defendant on instructions from the appellant/defendant Ms.Bharathi Siddesh, who appears in person in the Court today, submits that the appellant/defendant has handed over the vacant possession of the suit schedule property to the plaintiffs/respondents. This is acknowledged by the plaintiffs/respondents who are also present in Court, namely, Mr.T.V.T.Prakash and his wife, Smt.Chaya Prakash. 4. The learned counsel for the appellant/defendant submits that parties have settled all their inter-se disputes and no further dispute arises between them including for payment of any money. In view of the aforegoing, the learned counsel for the appellant/defendant has filed a Memo dated 15.04.2026, which is filed before the Court today, seeking to withdraw the present appeal. 6. Accordingly, the appeal is dismissed as withdrawn. All pending applications stand closed. 7. Since the matter has been compromised, the appellant/defendant is at liberty to take appropriate steps for withdrawal of the eligible court fee.
