Petition under Article 226 of the Constitution of India praying that in the circumstances stated in the affidavit filed therewith, the High Court may be pleased to issue an appropriate Writ, Order or direction more particularly one in the nature of WRIT OF MANDAMUS declaring the inaction on the part of the Respondents in respect of release of an amount of 1. Rs.55,000/- (Fifty Five Thousand Rupees only), 2. Rs.1,22,000/- ( One Lakh Twenty Two Thousand Rupees only) and 3. Rs. 1,63,000/- ( One Lakh Sixty Three Thousand Rupees only) to the petitioner in respect of execution of work by the petitioner i.e., 1. Restoration of defunct DBS schemes in Munagapadu G.P of Konakanamittia Mandal 2. Providing new bore well and Motor at M. O R D E R This Writ Petition is filed seeking the following relief:
“….to issue an appropriate Writ, Order or direction more particularly one in the nature of Writ of Mandamus, declaring the inaction on the part of the respondents in respect of release of an amounts of Rs.55,000/-, Rs.1,22,000/-, and Rs.1,63,000/- to the petitioner for execution of work i.e. (1) Restoration of defunct DBS Schemes in Munagapadu G.P. of Konakanamittla Mandal; (2) Providing new bore well and motor at M.Narayana House in Munagapadu Village and Gram Panchayat of Konakanamittla Mandal, and (3) Providing new bore well and motor at Boddurayi in Munagapadu Village and Gram Panchayat of Konakanamittla Mandal, as illegal, irregular, arbitrary and unconstitutional and against the principles of natural justice and in violation of Articles 14 and 21 of the Constitution of India, and consequently, direct the respondents to pay the total contract bill amount i.e. Rs.3,40,000/- for the aforesaid works along with interest and pass such other order or orders …”

Heard learned counsel for the Writ Petitioner, learned Assistant Government Pleader for Panchayat Raj and Rural Development representing respondent No.1, learned Assistant Government Pleader for Finance and Planning, representing respondent Nos.3 to 5, and learned Standing Counsel for Gram Panchayat, representing respondent No.6. 3. The Writ Petitioner claims to be a Civil Contractor. The Writ Petitioner was awarded the contract works viz. Restoration of defunct DBS schemes in Munagapadu Gram Panchayat of

Konakanamittla Mandal, providing new bore well and motor at M.Narayana House in Munagapadu Village and Gram Panchayat, providing new bore well and motor at Boddurayi in Munagapadu Village and Gram Panchayat of Konakanamittla Mandal, and completion of incomplete Gram Pancahayat at Munagapadu Village and Gram Panchayat of Konakanamittla Mandal. The Writ Petitioner executed the entire work within time.
The respondent authorities inspected the site and entered the completed contract work in Measurement Books. Though the assigned work was completed by the Writ Petitioner, an amount of Rs.3,40,000/- was kept pending by the respondent authorities. Even the Writ Petitioner approached the respondent authorities on multiple occasions, requesting for payment of pending bill amount of Rs.3,40,000/-, they are not doing so. According to Writ Petitioner, having executed the work satisfactorily, within the prescribed time, non-payment of the bill amount was arbitrary and unjustified. It was further contended that the delay in payment is causing severe financial hardship, necessitating the filing of the present Writ Petition seeking appropriate directions for release of the outstanding amount. 4. Learned Assistant Government Pleader for Panchayat Raj and Rural Development, on written instructions received from the

Assistant Executive Engineer, RWS&S Section, Konakanamittla-4th respondent, submits that there is no dispute with regard to the execution of the subject work by the Writ Petitioner. She further submits that in respect of the work bill concerned, they were already submitted to the Gram Panchayat, Munagapadu Gram Panchayat of Konakanamittla Mandal for making payment. The written instructions are placed on record. 5. Learned counsel representing the learned Standing Counsel for Gram Panchayat, representing respondent No.6, concedes with the submission made by the learned Assistant Government Pleader for Panchayat Raj and Rural Development. She submits that the payment under 15th Finance Commission is entirely depended upon the release of funds by the competent Government authorities, and the amounts due to the Writ Petitioner will be released in accordance with the availability of funds and the financial position of the Gram Panchayat and thereby, she prays time for clearing the pending bill amount. The written instructions are placed on record. 6.
Having regard to the fact that there is no dispute with regard to the works executed by the Writ Petitioner and the amount payable to him, and in view of the submissions of the learned counsel representing the learned Standing Counsel for Gram Panchayat, the

respondent authorities are directed to pay an amount of Rs.3,40,000/- (Rupees Three Lakhs Forty Thousand Only) to the Writ Petitioner within a period of Four (4) weeks from the date of receipt of a copy of this order. 7. Accordingly, the Writ Petition is disposed of. There shall be no order as to costs of the Writ Petition.
