JUSTICE SHIVASHANKAR AMARANNAVAR ORAL ORDER This petition is filed by sole accused under Section 482 of BNSS praying to grant anticipatory bail in Crime No.120/2022 of Aldur Police Station registered for offences under Sections 504, 354, 324, 323, 326 of IPC pending in C.C.No.410/2023 on the file of Prl.Civil Judge and JMFC, Chikmagalur. 2. Heard learned counsel for the petitioner and learned HCGP for respondent/State. 3. Learned counsel for the petitioner would contend that petitioner, CW.1 and CW.2 are relatives. There was a dispute among them. The injured, who has sustained fracture, has been discharged from the hospital. The petitioner has not been arrested. The incident has taken - 3 - HC-KAR NC: 2026:KHC:4766 CRL.P No. 17147 of 2025 place on 04.11.2022. As the charge sheet is filed, the petitioner is not required for custodial interrogation. With this, he prayed to allow the petition. 4. Per contra, learned HCGP would contend that the petitioner has assaulted CW.2 and outraged her modesty and when CW.1 came to rescue her, he has assaulted him with coffee stick on his knee and caused fracture. CW.3 is the eyewitness to the incident. The charge sheet material show prima-facie case against the petitioner for the offence alleged against him. With this, he prayed to reject the petition. 5. Having heard the learned counsels, the Court has perused the charge sheet and other materials placed on record. 6. The case of the prosecution as per charge sheet is that on 04.11.2022 petitioner was abusing CW.2 and held her hairs, assaulted on her head by hand and at that time CW.1 went to rescue her. At that time petitioner took a - 4 - HC-KAR NC: 2026:KHC:4766 CRL.P No. 17147 of 2025 coffee stick and assaulted CW.1 with it on his right knee and caused grievous injury and also assaulted on his lip with hand. The wound certificate, indicate only one injury i.e. fracture of patella bone on the right side. The said injury is opined to be grievous in nature. There is no injury on the lip of CW.1. The incident has taken place on 04.11.2022 and the charge sheet has also been filed on 15.03.2023. Now the matter is pending in C.C.No.410/2023 on the file of Principal Civil Judge and JMFC, Chikmagalur. As the charge sheet is filed, the petitioner is not required for custodial interrogation. There are no criminal antecedents of the petitioner. 7. Considering the above aspects, the petitioner has made out case for grant of anticipatory bail with conditions. In the result, the following: ORDER The petition is allowed. The petitioner is ordered to be released on bail, in the event of his arrest, in - 5 - HC-KAR NC: 2026:KHC:4766 CRL.P No. 17147 of 2025 C.C.No.410/2023 (Crime No.120/2022 of Aldur Police Station) pending on the file of Principal Civil Judge and JMFC, Chickmagalur, subject to following conditions: (i) Petitioner shall execute a personal bond for a sum of Rs.1,00,000/- with one surety for the like sum to the satisfaction of the jurisdictional Court. (ii) Petitioner shall appear before the jurisdictional Court within 15 days from this day and execute the bail bond and furnish surety. (iii) Petitioner shall not tamper the prosecution witnesses either directly or indirectly. (iv) Petitioner shall attend the trial Court on all dates of hearing unless exempted and co-operate for speedy disposal of the case.
