WP(MD). No.20087 of 2026 BEFORE THE MADURAI BENCH OF MADRAS HIGH COURT Dated : 15/07/2026 CORAM THE HON'BLE MR. JUSTICE MUMMINENI SUDHEER KUMAR WP(MD). No.20087 of 2026 and WMP(MD)Nos.14846 and 14849 of 2026 P.Perumal ... Petitioner Vs 1. The Commissioner, Tribunal For Disciplinary Proceedings No.4/929, 40 Feet Road, Rahamat Nagar, Maharaja Nagar Post, Tirunelveli District, Tirunelveli. 2. The Additional Superintendent of Police, Vigilance and Anticorruption, Tirunelveli District, Tirunelveli. ... Respondents PRAYER:- Writ Petition filed under Article 226 of the Constitution of India, praying this Court to issue a Writ of Certiorari to call for the records relating to the charge memo dated 20.01.2026 in ROC.No. A2/350/2025 (TDP No.04/2025) on the file of the first respondent and quash the same. For Petitioner : Mr.A.Mohan For Respondents : Mr.M.Dinesh Hari Sudarsan Counsel for Government of Tamil Nadu(Civil Side) 1/6 https://www.mhc.tn.gov.in/judis WP(MD). No.20087 of 2026 ORDER This writ petition has been filed assailing the charge memo dated 20.01.2026 issued by the first respondent-the Commissioner, the Tribunal For Disciplinary Proceedings, vide ROC.No.A2/350/2025 (TDP No.04/2025). 2. The only contention that is urged before this Court by the learned counsel for the petitioner is that the impugned charge memo has been issued without affording any opportunity to the petitioner and without issuing any Show Cause Notice to submit his explanation thereby violating the Rules 17(a) and 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules, 1955. 3. This Court, having taken note of the said contention, afforded an opportunity to the learned counsel for the petitioner to examine whether the Tamil Nadu Civil Services (Discipline and Appeal) Rules, 1955 would apply or the Tamil Nadu Civil Services (Disciplinary Proceedings Tribunal) Rules, 1955 would apply. 2/6 https://www.mhc.tn.gov.in/judis WP(MD). No.20087 of 2026 4. The learned counsel for the petitioner, however, stuck to his contention that the impugned charge memo has been issued in violation of Rules 17(a) and 17(b) of the Tamil Nadu Civil Services (Discipline and Appeal) Rules, 1955. 5. This Court, having considered the said submission and perused the entire materials including the impugned charge memo dated 20.01.2026, is unable to accept the contention of the petitioner as the impugned charge memo is issued in terms of the Tamil Nadu Civil Services (Discipline and Appeal) Rules, 1955. There is nothing brought to the notice of this Court that there is violation of any of the Tamil Nadu Civil Services (Disciplinary Proceedings Tribunal) Rules, 1955 and therefore, the question of the first respondent complying with the Rules 17(1) or 17(b) of Rules, 1955 while issuing the impugned charge memo does not arise as the impugned charge is relating to a corruption charge. In the circumstances, this Court does not find any reason to interfere with the impugned charge memo at this stage. 3/6 https://www.mhc.tn.gov.in/judis WP(MD). No.20087 of 2026 6. Accordingly, this writ petition is dismissed. No costs. Consequently, connected miscellaneous petitions are closed. 7. However, considering the request made by the learned counsel for the petitioner for timely conclusion of the disciplinary proceedings and taking into consideration the orders issued by the Government in G.O.(Ms.)No.81, Human Resources Management(N) Department dated 04.08.2022 fixing six months as outer time line for conclusion of the disciplinary proceedings, the first respondent is directed to take all necessary steps for conclusion of the disciplinary proceedings as expeditiously as possible, at any rate, within a period of six months from the date of the appearance of the petitioner before the first respondent. 15.07.2026 NCC : Yes/No Index : Yes/No Internet : Yes/No CM 4/6 https://www.mhc.tn.gov.in/judis WP(MD).
