CMP No.699 of 2026 The present application under Order 1 Rule 10 CPC has been filed by the legal representatives of deceased applicant/respondent No.1, Bindra Devi, who has died on 12.04.2020, for their impleadment in her place. The application is duly supported with the affidavit of LR Kamlesh Kumar. Learned vice counsel for the non-applicant/appellant submitted that he doesn't intend to file any reply to the present application and has no objection, in case, the same is allowed. Heard. Since respondent No.1, Bindra Devi, has expired on 12.04.2020, as is evident from the death certificate, annexed with the application and on the basis of Will, applicants as mentioned in Para-1 of the application, are his legal heirs, which fact is also evident from the legal heir certificate Annexure-A, annexed with the application, the present application is allowed and applicants as mentioned in Para-2 of the application, are ordered to be substituted in place of respondent No.1, Bindra Devi, whose name is otherwise ordered to be deleted from the array of the parties. Amened memo of parties filed with the application, is ordered to be placed on record. Application stands disposed of. CMP No.702 of 2026 The instant application has been filed by the applicants/respondents No.1(a) to 1(d), namely Kamlesh Kumar Sen, Dalbir Singh Sen, Suresh Kumar Sen & Omkar Singh Sen, for release of award amount alongwith up-to-date interest in their favour, as per their shares, as lying deposited in the Registry of this Court. Learned vice counsel for the non- applicant/appellant stated that he doesn’t intend to file any reply to the application. He further stated that since the main appeal stands finally decided on 28.06.2017 by this Court and as no appeal has been preferred against the said judgment by either of the parties, the same has attained finality, he has no objection in case the prayer made in the application is allowed. Heard.
Having perused the averments made in the application, which are duly supported with the affidavits of the applicants coupled with the fact that the judgment passed by this Court has attained finality, this Court finds it in the interest of justice to release the award amount alongwith up-to-date interest as lying deposited in the Registry of this Court in favour of applicants/respondents No.1(a) to 1(d), namely Kamlesh Kumar Sen, Dalbir Singh Sen, Suresh Kumar Sen & Omkar Singh Sen, strictly as per their shares,
after proper verification and identification, by remitting the same to their saving bank accounts, details whereof have been mentioned in copies of pass books, attached with the application as (Annexure R-1, colly).
