IN THE HIGH COURT OF ORISSA AT CUTTACK CONTC No.732 of 2026 Rasmita Das & Others …. Petitioners Mr. S.P. Lenka, Advocate -versus- Artratrana Sethy, Inspector- in-Charge, Kandarpur Police Station …. Opp. Party Mr. S.B. Mohanty, AGA CORAM: THE HON’BLE MR. JUSTICE CHITTARANJAN DASH Order No. ORDER 20.03.2026 01. 1. The present contempt application has been moved by the Petitioner for non-compliance of the order dated 17.11.2025 in CRLMP No.1386 of 2025, passed by this Court. 2. For reference, the order dated 17.11.2025, is reproduced hereby as follows:- “In view of such submissions of the learned counsel for the Petitioners and the allegations appearing in the complaint, it is directed that the IIC, Kandarpur P.S. shall examine the report and if the report reveals a cognizable offence, to register the same and proceed with the investigation in accordance with law.” 3. As per the compliance report of the IIC, Kandarpur P.S. dated 24.02.2026, the investigation has been completed p. 2 and charge-sheet has been filed against the accused persons vide C.S. No.234 of 2025 and C.S. No.225 of 2025. Perusal of the operational part of the order reveals that the direction had been issued to the concerned IIC, Kandarpur P.S. to examine the report and if the report reveals a cognizable offence, to register the same and proceed with the investigation in accordance with law. Consequently, there is no direction in particular which is violated thereby making the IIC amenable to contempt. In absence of any definite direction by this Court, and the detailed instructions placed by the learned AGA, the contempt cannot be proceeded with. Hence, the same is dropped.
