4. This is an application seeking recall of our
order dated 26.02.2026 by which the instant appeal was dismissed with a cost of Rs.25,000/ - noticing that the order of learned Single Judge impugned in the appeal was challenged by the State earlier by way of Special Appeal No. 233 of 2024, and subsequently it was got dismissed as withdrawn. The application is on the ground
that the appellants in fact intended to challenge
order dated 10.02.2025 passed by learned Single Judge in same matter by which the recall application for recalling order dated 03.01.2024, was rejected.
5. Mr. B.S. Parihar, learned Additional Chief Standing Counsel after making submissions at quite some length states that he is not pressing the application and it may be rejected as not pressed.
6. Having regard to the prayer made, the recall application (MCC No. 03 of 2026) is rejected.
In consequence, Amendment Application (I.A. No. 04 of 2026), seeking amendment in the memo of appeal also stands rejected.
