CORAM: HON'BLE MRS. JUSTICE P SREE SUDHA
CAV ORDER
This petition is filed by wife for transfer of M.C. No.3351 of 2024 filed by respondent-husband before I Additional Principal Judge, Family Court, Bengaluru to the Court of Senior Civil Judge and JMFC, Mulbagal. 3
2. In this petition, the petitioner-wife has stated that her husband, respondent herein, is practicing as an advocate. Her marriage with respondent was performed on 01.09.2022 and they are blessed with a male child on 17.07.2023 and the boy is aged 2 years now. It is stated that she is residing along with her parents at Mulbagal, but, her husband has filed matrimonial case at Bengaluru. It is inconvenient for her to travel all the way along with the minor child to Bengaluru. It is further stated that she has also filed CMC No.143 of 2024 for maintenance of minor child and another case in O.S. No.153 of 2024 for partition and separate possession in respect of joint family and ancestral property.
It is further stated that the distance between Courts at Mulbagal and Bengaluru is 120 kilometres on one side. The respondent is threatening her in public places and before the Court at Bengaluru. As such, she cannot attend the Court at Bengaluru and he is practicing in the same court. Thus, requested for transfer of M.C. No.3351 of 2024 to the Court of Senior Civil Judge and JMFC, Mulbagal. 3. In the objection filed by the respondent-husband in M.C. No.3351 of 2024, he has given the office address of his Counsel as his address. It was stated that he is a junior advocate by
4 profession and getting the income of Rs.10,000 /- per month. Though husband of the petitioner was not residing at Bengaluru, he misrepresented before the Court by furnishing counsel’s office address as his address. Moreover, he is an advocate practicing here as such. It is further stated by the petitioner that the case is posted for cross examination of P.W.1. Therefore, this Court finds it just and reasonable to transfer M.C. No.3351 of 2024 from I Additional Principal Judge, Family Court, Bengaluru to the Court of Senior Civil Judge and JMFC, Mulabagal, as the other two cases are also pending before the same Court. Ordered accordingly. In the result, the petition is allowed. Sd/- (P SREE SUDHA) JUDGE
